Date: Thu, 16 Sep 1993 12:29:10 -0500 0C RESOLUTION NO. 21381 A RESOLUTION TO SUBMIT A PROPOSED PLAN OF SERVICES TO THE CHATTANOOGA-HAMILTON COUNTY REGIONAL PLANNING COMMISSION FOR REVIEW RELATIVE TO THE PROPOSED ANNEXATION OF CERTAIN PROPERTIES ADJACENT TO INTERSTATE 75 AND LEE HIGHWAY, MORE SPECIFICALLY DESCRIBED HEREIN, LYING CONTIGUOUS TO THE PRESENT CORPORATE LIMITS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That a proposed plan of services, a copy of which is attached hereto and incorporated herein by reference, relative to the proposed annexation of certain properties adjacent to Interstate 75 and Lee Highway, more specifically described herein, lying contiguous to the present corporate limits, be and is hereby submitted to the Chattanooga-Hamilton County Regional Planning Commission for study and a written report pursuant to Tennessee Code Annotated A7 6-51-102 to be rendered within ninety (90) days hereafter. The legal description of said properties is designated as set forth below and is included with the proposed plan of services attached hereto and made a part hereof by reference. The legal description for the property to be annexed is set forth as follows: BEGINNING at a point in the existing City Limit Line of Chattanooga, Tennessee, at the intersection of the centerline of the Southern Railway and the northwest right-of-way line of US Highway I-75; thence, in a northeastern direction along the northwesterly right-of-way line of U.S. Highway I-75 and the 0C southeastern property line of Parcels 099.2, 043, across the right-of-way of Country Village Drive, Parcels 042.02, 042.01, 0041, 039, across the private right-of-way for Hilltop Drive, Parcels 036, 037, 034, 034.01, across the right-of-way of Hunter Road, Parcels 074.01, 074, 075.01, 075.02, 075, 076, 075, across the right-of-way of Snowhill Road, of Hunnicutt Tax Map 131 and continuing in a northeasterly direction along said U.S. highway right-of-way and the southeastern property line of Parcel 3, Map Number 132 to its southeastern property corner; thence, in a southeasterly direction to the common corner between Parcels 002 and 002.04, Map 132; thence along the common lot line between Parcels 002 and 002.04, Map 132, to the most eastern corner of said parcel 002; thence, in a southeasterly direction, 500 feet from and parallel to Lee Highway, for a distance of 1,300 feet to a property line; thence, perpendicular to Lee Highway, a distance of 500 feet to the northern right-of-way line of Lee Highway at the southwestern property corner of Parcel 027.02, Map 132; thence, along the northern right-of-way line of Lee Highway, passing along the southern property lines of Parcels 027.02, 027.01, AND 027, Map 132, to the western property line of Parcel 029, Map 132, a distance of 1,250 feet; thence, along the northern property line of said Parcels 096.01, and 092, Map 131, to the eastern right-of-way line of the Little Debbie Parkway; thence, crossing Little Debbie Parkway, continuing with the southern right-of-way line of the Southern Railroad Company, along the northern property lines of Parcels A-023, A-024.09, A-024.05, A-024, A-025, A-027, and A-028, Map 131K, to the eastern right-of-way line of Lee Highway; thence, crossing Lee Highway at its intersection with Old Cleveland Pike, continuing along the southeastern right-of-way of the Southern Railroad Company in a southwesterly direction, passing along the northwestern property lines of Parcels 012, 014, 015.05, 015.04, 015.03, 015.02, 015.01, 015, 016, 017, 018, Map 131, to the northwestern right-of-way line of Old Cleveland Pike; thence, in a southwesterly direction, along the aforementioned Southern Railroad and Old Cleveland Pike rights-of-way, a distance of 2,850 feet, more or less, to the northernmost property corner of Parcel B-020, Map 131P; thence, continuing with the Southern Railroad right-of-way line in a southwesterly direction, along the northwestern property lines of B-020, B-019, B-018, B-017, B-016, B-015, B-014, B-013, B-012, B-011, B-009, B-003, Map 131P, to the existing right-of-way of Old Cleveland Pike; thence, crossing Old Cleveland Pike to the northwestern property corner of Parcel B-001; thence, along the western property line of said Parcel B-001, to the north right-of-way line of Apison Pike, being also a point in the existing Chattanooga City Limit Line; thence, along the northern right-of-way line of Apison Pike, continuing with the city limit line, and following the southern property lines of Parcels A-001, A-002, A-003, A-008, A-009, A-010, A-011, A-011.01, A-012.01, A-012, Map 131P, to the southwestern property corner of said Parcel A-012; thence,in a westerly direction along the common right-of-way line of the 0C Southern Railroad Company and Old Lee Highway, being also the existing city limit line, a distance of 1,500 feet, more or less, to the center line of U. S. ADOPTED: May 20, 199709 PAN:kac 0C PROPOSED PLAN OF SERVICES IN ACCORDANCE WITH TENNESSEE CODE ANNOTATED A76-51-102 The City Council of the City of Chattanooga, Tennessee hereby proposes the following Plan for Provision of Services for an annexation area of certain properties adjacent to Interstate 75 and Lee Highway, lying contiguous to the present corporate limits of the City of Chattanooga, Tennessee as set forth within the attached Resolution. A. POLICE Patrolling, radio directed response to calls for assistance, crime prevention services, traffic control and accident prevention services and other police protection and support using present personnel and equipment will be provided on the effective date of annexation. B. TRAFFIC ENGINEERING Traffic engineering and installation of signs and other traffic control devices to be installed as required throughout the annexation area, when the need is established by appropriate traffic studies. C. FIRE 1. Fire protection by present personnel and the equipment of the fire fighting force within the limitations of available water and distance from fire stations will be provided on the effective date of annexation. 2. Additional fire services such as those made available through the City's fire prevention bureau and its arson 0C investigation unit will be made available on the effective date of annexation. 3. Within six months after annexation, fire hydrants will be installed in those areas where water mains of adequate size are available. Placement of hydrants will be on the basis of nationally-accepted standards defined by the National Fire Underwriters' Association. As additional water lines are extended into areas that are not presently served, fire hydrants shall be installed as required by the above-mentioned standard. 4. Within six months after annexation a study will be completed to determine the need for the establishment of a fire substation in or near the annexed area to assure the continued compliance with standards established by the National Fire Underwriters appropriate to the existing fire insurance rating. D. REFUSE COLLECTION The same regular refuse collection now provided by the City will be extended to the annexed area on the effective date of annexation. E. STREETS 1. Emergency maintenance of streets (repair of hazardous chuck holes, measures necessary to maintain normal traffic flow), removal of snow and/or sanding of streets during icing conditions will begin on the effective date of annexation. 2. Routine maintenance, on the same basis as in the present City, will begin in the annexed area following the effective date of annexation. 0C 3. Within six months of annexation, street name signs will be installed as needed in all substantially developed areas. 4. Street lights will be installed under the same standards as now prevail in the City. F. PLANNING AND ZONING The planning and zoning jurisdiction of the City will extend to the annexed area on the effective date of annexation. City planning will thereafter encompass the annexed area. Pending a review of the zoning by the Chattanooga-Hamilton County Planning Commission and the City, the property shall be re-classified to a temporary classification pursuant to Article X, Section 100 of the City's Zoning Ordinance. G. RECREATION FACILITIES 1. All of the recreational areas and programs provided for the present City residents will be made available immediately to the residents of the annexed area. 2. Summer recreation programs such as softball tournaments and Little League will be made available to all residents. H. WATER SYSTEM Water for domestic, commercial and industrial uses will continue to be provided to residents of the newly annexed area by the Eastside Utility District. I. ELECTRICAL SERVICE Electricity for domestic, commercial and industrial uses will continue to be provided to residents of the newly annexed area by the Electric Power Board of Chattanooga. 0C J. SEWER SYSTEM The existing Moccasin Bend Wastewater Treatment Plant is adequately sized to treat the flow from its Chattanooga service area. Interceptor sewers have been constructed nearby to transmit flow within the existing City boundaries and to the City of Chattanooga sewage treatment facilities. Sewers will be extended into the annexed area in accordance with the overall sewage development plan. K. INSPECTION/CODE ENFORCEMENT Chattanooga now provides inspection and code enforcement services (building, electrical, plumbing, gas, and better housing) to all areas of the City. These same services will be provided to the newly annexed area when it becomes a part of the municipality. L. ANIMAL CONTROL The Humane Educational Society of Chattanooga provides the services of animal control and enforces the City's leash laws and other animal control ordinances. This service will be available in the new area when the annexation becomes effective.
